Operations are typically run by multi-agency task forces under an operational plan that defines the persona, where it will be deployed, what the officer may and may not say, and what will constitute the point at which an offence is complete. Officers operating personas receive specific training, and that training addresses what they are permitted to initiate.
The operational plan, the training materials, the deconfliction records and any supervisory approvals are documents. They exist, they are obtainable, and they establish what the operation was supposed to do — against which what actually happened can be measured.
The Complete Communication Record
What appears in a charging affidavit is a selection. The complete record includes every message in sequence with timestamps, any communication on other platforms, and material from before the exchange that produced the charge.
Sequence is what matters. Who introduced the subject that makes the conduct criminal; at what point the persona stated an age and in response to what; whether the accused disengaged and what happened after that; whether the persona re-initiated after silence; and whether the exchange shows steering after hesitation. A summary that presents the accused’s statements without the prompts preceding them describes a conversation that did not occur in that form.
Jurisdiction and Venue
These cases raise jurisdictional questions that other cases do not. The accused may be in one state, the officer in another, the platform’s servers in a third, and the fictitious persona located wherever the operation says it is. Which sovereign may prosecute, and whether a state statute reaches conduct occurring largely elsewhere, are genuine questions rather than technicalities.
